§ 13-12. Other safety regulations.

  • (a)

    Each owner, operator, administrator, director, and staff members of each childcare facility with children five (5) years and younger shall ensure that there are barriers at least two (2) feet high with openings no more than four (4) inches in any dimension, with a bottom edge no more than four (4) inches from the floor, the width of the opening of the staircase, attached and held in place at the bottom of each internal staircase in the childcare facility.

    (b)

    Each owner, operator, administrator, and director of each childcare facility shall ensure that all internal doors in the facility can be opened from both sides of the door.

    (c)

    The owner, operator, administrator, director, and staff members of each childcare facility shall ensure that chemicals, medications, and cleansers of all kinds are kept out of the reach of children at all times except when the chemical, cleanser, or medication is being actively used.

    (d)

    No staff member of any registered family home or parent's day out program may sleep during the period from 6:00 a.m. to 6:00 p.m. when any child who is not related to the caregiver is on the premises.

    (e)

    No staff member of any childcare facility shall prop a bottle for any infant.

    (f)

    Each owner, operator, administrator, and director of each commercial childcare facility shall ensure that there is no staff member or volunteer on the premises who is younger than eighteen (18) years of age. It is an affirmative defense to this subsection that the staff member or volunteer is a student in the facility as part of a school program or function.

    (g)

    The owner, operator, administrator, and director of each childcare facility shall ensure that the building is in compliance with the Uniform Building Code currently in effect as to safety glazing.
