§ 17-16. Subpoena.

  • (a)

    If the fire marshal determines during an investigation of a fire or an attempt to set a fire that additional information is necessary in determining the cause, origin, extent of damage or spread of the fire, the fire marshal may:

    (1)

    Subpoena witnesses to testify regarding the fire or the attempt to set a fire;

    (2)

    Administer oaths to the witnesses;

    (3)

    Take and preserve written statements, affidavits, and depositions; or

    (4)

    Subpoena or require the production of any documents, tapes or instrument that is pertinent to the investigation.

    (b)

    Failure to obey a subpoena shall be a violation of city ordinance.
