§ 20-9. Presumption regarding defendant's culpable mental state.

  • When a notice is sent certified mail, return receipt requested, postage paid and first class mail, postage paid to the person to whom a library card is assigned, or to a parent or guardian of a child to whom a library card is assigned, at the address shown by library records for that person, parent, or guardian, that a book, pamphlet, periodical, audio-visual item or other property owned or in the care, custody or control of the Irving Public Library System is overdue, it is presumed that a failure by the person, parent or guardian to return the materials named in the notice is intentional. This presumption is cumulative of other methods of showing the culpable mental state of the defendant.
