§ 21-170. When person arrested to be taken immediately before magistrate.

  • Whenever any person is arrested for any violation of this chapter, the arrested person shall be immediately taken before a magistrate who has jurisdiction of such offense in any of the following cases:

    (a)

    When a person arrested demands an immediate appearance before a magistrate.

    (b)

    In any other event when the person arrested refuses to give his written promise to appear in court as provided in this article.

    (c)

    When directed to do so by state law.
