§ 21-187. Speed limit of areas not within public streets.

  • (a)

    It shall be unlawful for any person to intentionally, knowingly or recklessly operate a motor vehicle at a speed greater than thirty (30) miles per hour at a location which is not upon a public street.

    (b)

    It shall be an affirmative defense to prosecution under this section if the operation of such vehicle at a speed in excess of thirty (30) miles per hour takes place only:

    (1)

    Upon a private race track, where contests of speed are regularly held and advertised, and no lot or residence depends upon this race track for access between the required parking spaces on said lot or residence and a public street; or

    (2)

    Upon the runway of any airport recognized and sanctioned by the Federal Administration; or

    (3)

    Be a person operating an authorized emergency vehicle.

    (c)

    Nothing in this section shall be deemed to alter or amend the speed limits or regulations upon any publicly maintained street, road, highway or alley. Further, nothing in this article shall be deemed to alter or amend any ordinance designating a speed limit on a specific street.

    (d)

    This section shall not be deemed a license or authorization to operate a motor vehicle at a speed of thirty (30) miles per hour and if operation of the vehicle at a lesser speed would be reasonable and prudent under the circumstances then existing, then the lesser speed should be observed and not the thirty (30) miles per hour speed.
