§ 25-1.4. Entry into city controlled water areas prohibited; affirmative defense.

  • (a)

    A person commits an offense if he swims, bathes, wades, dives, or goes into the water of a river, stream, pond, lake, drainage area or water course, either natural or artificial within or under the control of the city.

    (b)

    It shall be an affirmative defense to prosecution under this section to swim, bathe or wade in areas designated as swimming areas or beaches by the director of parks and recreation and in compliance with directions posted by the parks and recreation department.
