§ 34-28. Definitions.

  • The following words and phrases, when used in this article, shall have the meanings ascribed by this section:

    Abandoned newsrack. A newsrack that, unless the operator notifies the director of an unplanned or temporary interruption of publication, is not serviced or refilled with the operator's publication for:

    (1)

    Ten (10) consecutive business days for a daily or semi-weekly publishing cycle;

    (2)

    Twenty (20) consecutive business days for a weekly or bi-weekly publishing cycle; or

    (3)

    Thirty (30) consecutive business days for an occasional or less frequent than bi-weekly publishing cycle.

    Applicant. The person that applies for newsrack permit.

    Blockface. The linear distance of lots along one (1) side of a street between the two (2) nearest intersecting streets. If a street dead ends, the terminus of the dead-end street will be treated as an intersecting street.

    Board. The zoning board of adjustment sitting as a permit license and appeal board.

    City. The City of Irving, Texas.

    Director. The director of the department designated by the city manager to enforce and administer this article or the director's authorized representative.

    Newsrack. Any self-service or coin-operated box, container, storage unit, or other dispenser installed, used, or maintained to display, sell, or distribute, with or without charge, newspapers, periodicals, magazines, or other publications.

    Person. Any individual, corporation, business trust, estate trust, partnership, association, two (2) or more persons having a joint or common interest, or any other legal or commercial entity.

    Right-of-way. Any area dedicated to the public use for sidewalk, street, highway, or other transportation purposes including any curb, median parkway, shoulder, sidewalk, alley, drive, or public property.

    Permittee. A person issued a newsrack permit under this article.

    Visibility triangle. The area at the intersection of streets, rights-of-way, alleys, and driveways that shall remain clear and as further defined in Section 52-35a of Zoning Ordinance No. 1144 and Exhibit A to Section 52-35a.
