§ 41-24. Sanitary sewer connections required.

  • The owner or occupant of every building located on any lot or parcel of land within the city, the property line of which extends to within one hundred (100) feet of any sanitary sewer main adequate both as to size and grade to serve the property, shall construct or cause to be constructed, a suitable water closet upon the property, and shall connect or cause it to be connected with the sanitary sewer main in compliance with all provisions of this Code or other ordinances of the city regulating the construction.

    It is an affirmative defense to this section that the water closet is located in excess of two thousand five hundred (2,500) feet from the nearest sanitary sewer main owned by the city and the property between the sanitary sewer main and the water closet has been platted as one (1) lot.
