§ 41-62.7. Responsibility for cleanup.

  • (a)

    The property owner shall ensure that all cleanup operations incidental to the earthwork on the property including but not limited to leveling, establishment of ground cover, erosion control, and removal of all trash and other materials not suitable for fill including those deposited on streets, alleys, utility facilities, rights-of-way, and easements are completed and maintained.

    (b)

    If the property owner violates this section in any way, after ten (10) days after the city gives the property owner written notice that he or she is in violation of this section the city may remove all soil, rock, debris, and other materials deposited on streets, alleys, utility facilities, rights-of-way, and easements and bill the owner for the work. If the owner fails to pay the bill within thirty (30) days after the city sends it, the city may place a lien on the owner's property.
