§ 43-1. Definitions.

  • For the purposes of this chapter, the terms herein shall be defined as follows:

    (a)

    "Massage" shall mean the rubbing, kneading, tapping, compression, vibration, application of friction or percussion of the body, or parts of the body, by hand or with an appropriate instrument or apparatus for pay.

    (b)

    "Massage establishment license" shall mean that document issued by the city manager to an establishment where massages are furnished and shall be valid for a period of one (1) year only.

    (c)

    "Massaginist license" shall mean the document issued by the city manager to a person who administers massages and shall be valid for a period of one (1) year only.

    (d)

    "Massaginist" shall mean a person who administers massages.

    (e)

    "Massage establishment" shall mean any building, room, place or establishment, where manipulated massage or manipulated exercises are practiced upon the human body for pay by anyone not a duly licensed physician, osteopath, chiropractor or a registered nurse or licensed vocational nurse acting at the direction of a doctor whether with or without the use of mechanical, therapeutic or bathing devices, and shall include Turkish bathhouses. This term shall not include, however, duly licensed beauty parlors or barber shops or a place wherein registered physical therapists treat only patients recommended by a licensed physician and operate only under such physician's direction nor shall it apply to athletic trainers of bona fide athletic teams when said trainers are massaging members of said team or hospital or clinic.

    (f)

    "Genitals" shall mean the external sexual organs.

    (g)

    "Chief of police" shall mean the person occupying the position of chief of police of the Irving Police Department or a member of said department designated by the chief of police to be responsible for the responsibilities imposed upon the chief of police by Chapter 43 of the Code of Civil and Criminal Ordinances of the City of Irving, Texas.
