§ 44-11. Responsibility of licensee, permittee or operator.

  • (1)

    A licensee, permittee or operator shall not permit any of the following activities upon the premises of an amusement center or amusement store for which said person is responsible:

    (a)

    Violation of any possession, sale or delivery provision in subchapter four of the Texas Controlled Substances Act;

    (b)

    Violation of any provision in Section 106.06 of the Texas Alcoholic Beverage Code;

    (c)

    Prostitution;

    (d)

    Gambling;

    (e)

    A person younger than sixteen (16) years of age to operate a coin-operated amusement machine between the hours of 7:30 a.m. to 3:30 p.m. during the regular school days of the fall or spring term of the Irving Independent School District;

    (f)

    Violation of Section 42.01 of the Penal Code on the premises of any amusement center or amusement store.

    (2)

    For the purpose of section 44-11, "premises" means the interior of an amusement center or amusement store or any other area in close proximity to the amusement center or amusement store to which the public has access and which is under the control of the licensee, permittee or operator such as a parking facility or private sidewalk.
