§ 57-1. Definitions.

For purposes of this chapter, the following terms shall have the following meanings:

Aerosol paint container means any aerosol container, regardless of material from which it is made, which is adapted or made for the purpose of spraying paint capable of defacing property.

City means the City of Irving.

Director means the director of the department of public works or his designee or another employee of the city designated by the city manager.

Graffiti means any inscription, work, figure, marking or design that is marked, etched, scratched, drawn or painted on any building, structure, fixture or other improvement whether permanent or temporary, whether public or private, without the consent of the owner of the property or the owner's authorized agent, and which is visible from any public property or the public right-of-way, or from any private property other than the property on which the graffiti exists, including, by way of example only and without limitation, fencing surrounding sites.

Guardian means a person who, under court order, is the guardian of the person of a minor; or a public or private agency with whom a minor has been placed by a court.

Marker pen means any indelible marker or similar implement with writing tip exceeding three-sixteenths (.1875) inch in width that contains a solution that cannot be removed with water after it dries.

Minor means any person under seventeen (17) years of age.

Owner shall mean the owner of record of the real property as set forth in the records of the tax department of the city or of other tangible property.

Parent means a person who is a natural parent, adoptive parent, foster parent, or step-parent of another person.
