§ 62-1. Fee waivers—Community groups.

  • (a)

    Definitions.

    Community group means a group or individual performing repair work on a qualified residence for a resident owner at no charge for labor.

    Department director means the director or chief of any City of Irving department or division and his or her designee.

    Qualified residence means an owner occupied residence that is in a structure that does not produce income for its owner.

    Resident owner means a person who is disabled or over sixty (60) years of age, whose household income is fifty (50) percent or less of the median income for the City of Irving, who resides in a structure that does not produce income for him or her, and who is not able to pay for repairs or construction work on the structure.

    (b)

    Fee waiver.

    (1)

    A department director may waive any fee adopted by City of Irving ordinance except water and sewer hookup fees for a community group for repair on a qualified residence performed for the benefit of a resident owner.

    (2)

    To obtain a waiver of a fee or fees, the community group or resident owner must submit to a director a correctly completed application on a form provided by the city, a copy of the resident owner's income tax return for the year previous to the year in which the fee waiver is sought, and an affidavit of the resident owner's inability to pay the fee or fees for which the waiver is sought executed by the resident owner.

    (3)

    This section prevails in all cases in which it is in conflict with or inconsistent with any other City of Irving ordinance.
