§ 6-10. Hogs, sows, pigs prohibited in city; affirmative defense for potbellied pigs; requirements for keeping potbellied pigs; requirements for keeping bees.

  • (a)

    It is unlawful to maintain and keep any hog, sow, or pig in the city.

    (b)

    It is an affirmative defense to subsection (a) that the animal is a potbellied pig, which meets the following requirements:

    (1)

    That there are no more than two (2) adult potbellied pigs in any one (1) household within the city;

    (2)

    The animal is no more than eighteen (18) inches high at the shoulder and no more than three (3) feet long;

    (3)

    The animal weighs no more than two hundred (200) pounds;

    (4)

    It is indoors at all times other than times for evacuation of waste material or during exercise periods;

    (5)

    It is not in violation of any applicable provision of this chapter;

    (6)

    It receives annual vaccinations for erysipelas; and

    (7)

    The owner or harborer of the potbellied pig has annually submitted to the animal control supervisor an erysipelas vaccination certificate from a licensed veterinarian that includes the following information:

    a.

    Name and address of the pet owner or harborer;

    b.

    Name and address of licensed veterinarian issuing certificate;

    c.

    Description, including weight and height, and name of the pet;

    d.

    Date of vaccination;

    e.

    Tag number; and

    f.

    Other appropriate information.

    (c)

    If the potbellied pig dies or moves or acquires a new owner or harborer, the registered owner or harborer shall so inform the animal services manager.

    (d)

    No person shall keep any weaned potbellied pig without a permit to keep a potbellied pig.

    (e)

    To obtain a permit, an applicant shall submit a correctly completed application and a twenty dollar ($20.00) nonrefundable fee to the animal services manager for processing the application.

    (f)

    Keeping bees. A person who keeps bees shall:

    (1)

    Maintain each colony in a healthy state;

    (2)

    Maintain the grounds near each hive in a sanitary manner;

    (3)

    Ensure that a convenient source of water is available to each colony at all times;

    (4)

    Mark each hive with the name and telephone number of the beekeeper; and

    (5)

    The animal services manager shall have the authority to require a person to reduce the number of hives or require other reasonable safety precautions in an apiary in order to abate any nuisance.
