§ 8A-12. Appeals.

  • If the director denies the issuance or renewal of a permit or suspends or revokes a permit issued under this chapter, the action is final unless the permit holder files a written appeal within ten (10) days of the director's action with the zoning board of adjustment. For purposes of an appeal under this chapter, the zoning board of adjustment shall sit as a permit license and appeal board. If a written request for a hearing is filed timely, the zoning board of adjustment shall hear the appeal within sixty (60) days after the date the appeal is filed. The board shall hear and consider evidence offered by any interested person; the formal rules of evidence do not apply. The zoning board of adjustment's decision must be by a majority vote. Failure to reach a majority vote will leave the decision of the director unchanged. The decision of the board is final and no rehearing may be granted.
