§ 25. City attorney.

  • The city council shall appoint a city attorney. The city attorney shall be a person admitted to the practice of law by the State of Texas and shall have practiced law for at least four years. The city attorney shall be the chief legal advisor of all offices, departments and agencies and of all officers and employees of the city in matters relating to their official powers and duties. The city attorney shall represent the city in all legal proceedings. The city attorney shall perform all services incident to the position as may be required by statute, by the City of Irving Charter, or by ordinance. Final approval of the city attorney's budget and the expenditure of budgeted funds, as well as the classification and salary structure of city attorney's department employees, shall be the sole responsibility and prerogative of the city council. By approval of the city attorney's annual budget, administrative services required by other city departments in support of the approved budget are authorized. The city attorney shall hire, discharge and supervise other employees of such department.
