§ 35-11. Appeals to city council.

  • (a)

    Any applicant aggrieved by the decision or order of the planning and zoning commission in approving or disapproving a final plat shall have a right to appeal to the city council from such decision or order upon giving written notice of his intention to appeal to the city council to the director of community development within ten (10) days from the date of the order or decision of the planning and zoning commission.

    (b)

    Upon appeal to the city council, the city council shall consider the final or preliminary/final plat as submitted by the owner of the proposed subdivision and may either approve the final plat with such changes as may be recommended by the city council to conform to the terms and provisions of this chapter and other applicable ordinances of the city, or disapprove such final plat if it does not meet the requirements of this chapter and other applicable ordinances of the city.

    (c)

    Upon the approval of a final plat by the city council, evidence of such approval shall be by certificate on the final plat signed by the mayor, and attested to by the city secretary.
