§ 12-7. Municipal court building security fee.

  • (a)

    Assessment of fee. A defendant convicted of a misdemeanor offense in a municipal court of the city shall be assessed and required to pay a three dollar ($3.00) municipal court building security fee. Each misdemeanor conviction shall be subject to a separate assessment of the fee.

    (b)

    Collection of fee. The municipal court clerk is authorized and required to collect the fee and to deposit all fees collected in the municipal court building security fund.

    (c)

    Use of funds. The fund shall be used for the purpose of financing the purchase of security devices and/or services for the building or buildings housing the municipal courts of the city.

    (d)

    Definitions.

    (1)

    For purposes of this section, a person is considered convicted if:

    a.

    A sentence or fine is imposed on the person;

    b.

    The person receives community supervision, including deferred adjudication; or

    c.

    The court defers final disposition of the person's case.

    (2)

    For purposes of this section, security devices and/or services shall include any and all items enumerated in Article 102.017(d) of the Texas Code of Criminal Procedure which includes, but is not limited to:

    a.

    The purchase or repair of X-ray machines and conveying systems;

    b.

    Hand-held metal detectors;

    c.

    Walk through metal detectors;

    d.

    Identification cards and systems;

    e.

    Electronic locking surveillance equipment;

    f.

    Bailiff, deputy sheriffs, deputy constables or contract security personnel during times when they are providing appropriate security services;

    g.

    Signages;

    h.

    Confiscated weapon inventory and tracking systems; and

    i.

    Locks, chains or other security hardware; and

    j.

    Continuing education on security issues for court personnel and security personnel.
