§ 13-2. Definitions.

  • Child means a person under eighteen (18) years of age.

    Childcare facility means a facility that provides care, training, education, custody, treatment, or supervision for a child who is not related to the caregiver for all or part of the twenty-four-hour day, whether or not the facility is operated for profit and whether or not it charges for the services it offers.

    Children who are related to the caregiver means children who are the children, grandchildren, great-grandchildren, first cousins, nieces, or nephews of the caregiver, whether by affinity or consanguinity, or as the result of a relationship created by court decree.

    City means the City of Irving.

    City manager means the city manager of the City of Irving and his or her designee.

    Commercial childcare center means a childcare facility not in a residential structure that can provide care for seven (7) or more children under fourteen (14) years of age for less than twenty-four (24) hours a day, whether or not the center is operated for profit, and whether or not it charges for the services it offers.

    Department means the city public health and environmental services department.

    Director means the director of the city public health and environmental services department, and includes representatives, agents, or city employees employed in the public health and environmental services department, or otherwise designated by the director of the department.

    Facility means the people, administration, owner, operator, activities, operations, buildings, grounds, equipment, furnishings, and materials of a childcare facility.

    Fire marshal means the city fire marshal and his or her designees.

    Hard wired, with regard to smoke detectors, means to receive primary power from the building in which they are installed with battery backup power sources, wired in a series so that when one is activated, all are activated.

    Maintain means keep in proper operating condition at all times.

    Parent's day out program means a childcare facility program that is operated no more than two (2) days in any seven-day period and no more than twelve (12) hours in any seven-day period. For purposes of this chapter and compliance with its provisions, it shall be considered a commercial childcare facility.

    Permit means the certificate issued by the department that documents operating authority for a childcare facility operating in the city.

    Person means any individual, corporation, association, partnership, joint venture, or other entity.

    Registered family home means a childcare facility that provides care for no more than eight (8) children. This term does not include a home that provides care exclusively for any number of children who are related to the caregiver. This term does not include foster homes.

    Staff member means any person employed by or working at the facility whether paid by the facility or other person or entity or whether working for other consideration or as a volunteer.

    Valid permit means an unexpired, unrevoked city permit issued for the childcare facility in its current location to its current owner.

    Youth programs operated by the city means after school program sponsored and staffed by the city parks and recreation department which operates only during the school year and only after school on school days for children five (5) to thirteen (13) years of age. For purposes of this chapter and compliance with its provisions, it shall be considered a commercial childcare facility.
