§ 16E-2. Definitions.

  • For the purposes of this chapter:

    Aesthetic elements includes, but is not limited to any facing treatments including street pavers, colors in concrete and inserts placed in facings on buildings, on/in sidewalks, streets, and bridges, unique landscape treatments, unique water features, and unique usages of plant materials.

    Artist means a practitioner in the visual and design arts; generally recognized by critics and his/her peers as a professional who produces works of art.

    Nonprofit organization means a nonprofit organization as determined under the Federal Internal Revenue Service. This organization will be one recognized by the State of Texas as a "not-for-profit" corporation in Texas and recognized by the Internal Revenue Service as a 501(c)(3) charitable organization under the current Federal Income Tax Laws.

    Works of art includes, but is not limited to any original painting, sculpture, fountain sculpture, fresco, mobile, mural, collage, mosaic, bas-relief, tapestry, photograph, drawing, silk screen, etching, lithograph, and other physical elements of design.
