§ 20-6. Failure to return borrowed materials.

  • (a)

    Every person, who shall take or borrow from the Irving Public Library System any book, pamphlet, periodical, audiovisual item, or other property and intentionally, knowingly, or recklessly neglect, refuse or fail to return the same within fifteen (15) days of the date of mailing a violation notice by certified mail, return receipt requested, postage paid and first class mail, postage paid, shall be guilty of a violation of this section and on conviction thereof, shall be punished by a fine not to exceed five hundred dollars ($500.00) for each offense. Failure to return each book, pamphlet, periodical, audio-visual item or other property owned or in the care, custody or control of the Irving Public Library System shall constitute a separate offense and each day any violation of this section shall continue shall constitute a separate offense.

    (b)

    Every parent or guardian who has agreed to be responsible for each book, pamphlet, periodical, audio-visual item or other property owned or in the care, custody or control of the Irving Public Library System borrowed or taken by their child and who shall intentionally, knowingly or recklessly fail to return the same within fifteen (15) days of the date of mailing a violation notice by certified mail, return receipt requested, postage paid and first class mail, postage paid, shall be guilty of a violation of this section and on conviction thereof, shall be punished by a fine not to exceed five hundred dollars ($500.00) for each offense. Failure to return each book, pamphlet, periodical, audio-visual item or other property owned or in the care, custody or control of the Irving Public Library System shall constitute a separate offense and each day any violation of this section shall continue shall constitute a separate offense.

    (c)

    (1) The library is hereby authorized to refer a patron's overdue account to the library's contracted collection agency if said patron has failed to return overdue library materials in response to the library's normal notification procedures.

    (2)

    The library is further authorized to recover from every patron who fails to return borrowed library materials a fee commensurate with the direct costs that the city incurs in attempting to retrieve the overdue library materials through the collection agency. The amount of the pass-through fee shall be established by contract with the collection agency. This fee shall be added to the account of each patron who fails to return borrowed library materials when the account is referred to said collection agency for collection. This fee is in addition to any other fees, payments for lost materials, etc., that the library is authorized to collect.
