§ 25-1.6. Littering and pollution.

  • (a)

    No person shall throw or deposit litter in any park controlled by the City of Irving. It shall be an affirmative defense to prosecution under this section that the litter was placed in public receptacles and in such a manner that the litter will be prevented from being carried or deposited by the elements upon any part of the park or upon any street or other public place. Where public receptacles are not provided, all such litter shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere as provided herein.

    (b)

    No glass containers shall be permitted in a park or park facility under the ownership or control of the City of Irving.

    (c)

    No person shall throw or deposit litter in any fountain, pond, lake, stream, bay or any other body of water in a park or elsewhere within the city.

    (d)

    Garbage, trash, rubbish, litter or any other waste material or waste liquid generated on parks and incidental to authorized recreational activities shall be either removed from the park or deposited in receptacles provided for that purpose. The improper disposal of such wastes, human and animal waste included, in parks is prohibited.
