§ 44-9. Duties of licensee, permittee or operator.

  • (1)

    An amusement center shall not be open to the public unless an operator is physically present on the premises.

    (2)

    An amusement store shall not be open to the public unless an operator is physically present on the premises.

    (3)

    An operator must be a natural person who is:

    (a)

    At least eighteen (18) years of age; and

    (b)

    Has not been convicted within the last five (5) years of an offense involving robbery, drugs, gambling, prostitution, obscenity, unlawful carrying of a weapon, rape, sexual abuse, unlawful sale, possession or providing of alcohol, child molestation, or any offense involving sexual, assault, or public indecency offenses, as currently set forth in chapters 21, 22 and 48 of the Penal Code of the State of Texas.

    (4)

    It shall be unlawful for any person to be in charge of or serve as an operator of an amusement center or store if said person fails to meet the qualifications set forth in subsection (3), above.
