§ 44-10. Hours of operation.

  • (1)

    No licensee, operator or person shall operate an amusement center between the hours of 12:01 a.m. to 7:30 a.m. Sunday through Saturday; however, this shall not require the closing of the premises to other business if another business is being conducted thereon, in which event only the coin-operated amusement machines must be closed, locked or otherwise made inoperative during said prohibited period of time.

    (2)

    If an amusement center is located within five hundred (500) feet of a zoning district restricted to single-family residential use under either Zoning Ordinance No. 209, as amended, or Zoning Ordinance No. 1144, as amended, of the City of Irving, Texas, it shall be unlawful for the licensee or operator or any person to operate said amusement center except between the hours of 9:00 a.m. to 11:00 p.m., Sunday through Thursday and between the hours of 9:00 a.m. to 12:00 midnight, Friday and Saturday; however, this shall not require closing of the premises to another business if another business is being conducted thereon, in which event only the coin-operated amusement machines shall be closed, locked or otherwise made inoperative during said prohibited period of time.

    (3)

    For the purpose of this chapter, measurements shall be made in a straight line, without regard to intervening structures or objects, from the front door of the building or structure used as a part of the premises used as an amusement center to the nearest boundary of a district restricted to single-family residential use by either Ordinance No. 209, as amended, or Ordinance No. 1144, as amended.

    (4)

    It shall be unlawful for a licensee, permittee or operator to allow any person younger than sixteen (16) years of age to operate a coin-operated amusement machine between the hours of 7:30 a.m. to 3:30 p.m. during any regular school day of the fall or spring term of the Irving Independent School District.
