§ 54-31. Authority and duties of local health authority.

  • If the city council of the City of Irving should appoint a local health authority, the local health authority shall have no authority, control, nor supervisory control over the operation of the public health services division of the public health and environmental services department of the city but such local health authority shall have the authority granted a local health authority pursuant to Section 121.024, Texas Health and Safety Code which authority is set forth hereafter:

    (1)

    Enforce the laws and ordinances to protect the public health.

    (2)

    Aid the state board of health in the enforcement of orders, rules and regulations prescribed by the state board of health.

    (3)

    Establish, maintain and enforce quarantines in the health authority's jurisdiction;

    (4)

    Aid the state board of health in relation to local quarantine, inspection, disease prevention and suppression, birth and death statistics, and general sanitation in the health authority's jurisdiction;

    (5)

    Report the presence of contagious, infectious and dangerous epidemic diseases in the city to the state board of health, city council, city manager, designee of city manager and city health board in the manner and at the times prescribed by such board.

    (6)

    Report to the state board of health on any subject on which it is proper for such board to direct that a report be made.

    (7)

    Aid the state board of health in the enforcement of sanitation laws, quarantine rules and collections of vital statistics; and

    (8)

    Report to the city health board on any subject that will assist such board in its advisory role.

    (9)

    Delegate a power or duty imposed on the health authority by this article or state law to a properly qualified physician to act while the health authority is absent or incapacitated.
