§ 62-2. Same—Grants program.

  • (a)

    Definitions.

    Affordable housing means single-family or multi-family housing which meets affordability requirements as specified by U.S. Department of Housing and Urban Development regulations at 24 CFR 92.252 and 92.254.

    Department director means the director or chief of any City of Irving department or division, or his or her designee.

    Grant recipient means any person or entity, including a homeowner, a contractor, or a subrecipient entity, which has contracted with the city's Community Development Department Grants Program to receive Community Development Block Grant or HOME Investment Partnerships Grant funds for the rehabilitation or development of affordable housing.

    Low or moderate income resident means an Irving household whose income is less than eighty (80) percent of the area median income, adjusted for family size, as established annually by the U.S. Department of Housing and Urban Development.

    (b)

    Fee waiver.

    (1)

    A department director shall waive any development or building inspections fee adopted by City of Irving ordinance upon an applicant's compliance with subsection (3) herein, except any water and sewer hookup fees which may be restricted through bond covenant, for grant recipients for work on affordable housing projects which are funded through the Community Development Block Grant or the HOME Investment Partnerships Grant.

    A department director shall reimburse any City of Irving development or building inspections fees upon an applicant's compliance with subsection (3) herein, except any water and sewer hookup fees which may be restricted through bond covenant, for grant recipients for work on affordable housing projects within the six (6) months prior to May 25, 2000, which are funded through the Community Development Block Grant or the HOME Investment Partnerships Grant.

    (3)

    To obtain a waiver or reimbursement of a fee or fees, the grant recipient must submit to a director or his or her designee a correctly completed application on a form provided by the city, executed by an authorized representative of the grant recipient, which designates the site and nature of the affordable housing project and is verified by the city as funded with Community Development Block Grant or HOME Investment Partnerships Grant funds.

    (4)

    This section prevails in all cases in which it is in conflict with or inconsistent with any other City of Irving ordinance.

    (5)

    The city council hereby dedicates the total value of all such waived fees to the city's HOME Investment Partnerships Grant Program as a portion of its matching contribution, to be documented and summarized annually and submitted to the U.S. Department of Housing and Urban Development.
