§ 44-3. License or permit application.

  • (1)

    An applicant for a license or permit shall file with the chief of police a written application on a form provided for that purpose, which shall be signed by the applicant, who shall be the owner of the amusement center or amusement store business. Should an applicant maintain an amusement center or amusement store at more than one location, a separate application must be filed for each location. The following information is required in the application:

    (a)

    Name, address, telephone number and driver's license number of the applicant if a natural person; name, address, telephone number and driver's license number of all persons who own ten (10) percent or more interest in the amusement center or amusement store business; name, address, telephone number and driver's license of all corporate officers, if any, of the amusement center or amusement store; name, address, and telephone number of the amusement center or amusement store; and if incorporated, the name of the business registered with secretary of state;

    (b)

    Name, address and telephone number of the operators of the amusement center or amusement store and proof that the operators are at least eighteen (18) years of age;

    (c)

    Whether the applicant, operator(s), or persons owning ten (10) percent or more interest in the amusement center or amusement store, and, if applicable, any corporate officer of the applicant has been convicted within the preceding five (5) years of an offense involving drugs, gambling, prostitution, obscenity, unlawfully carrying a weapon, robbery, rape, sexual abuse, unlawful sale, possession or providing of alcohol, child molestation, or any offense involving sexual, assault, or public indecency offenses, as currently set forth in chapters 21, 22 and 48 of the Penal Code of the State of Texas;

    (d)

    The previous occupation of the applicant, operator(s) and, if applicable, all corporate officers of the applicant within the preceding five (5) years;

    (e)

    Whether a previous license or permit of applicant, or, if applicable, corporate officer of applicant, has been revoked within two (2) years of filing of the application;

    (f)

    Number of coin-operated amusement machines in the center or store; and

    (g)

    A statement that all the facts contained in the application are true.

    (2)

    No applicant may maintain any amusement center or amusement store in violation of the comprehensive zoning ordinance of the city.
